Contrefaçon... et droit d'auteur.
Et voilà, je suis devenu une cible pour les vendeurs de contrefaçons !Tous les jours, depuis une semaine, je trouve sur ma boîte auxc lettres éléctronique d'alléchantes propositions pour acheter à prix abordable Rollex, Cartier, etc.
Peut-être pour masquer ces messages publicitaires et détourner les soupçons des surveillances automatiques, suivent des extraits de romans, soit Harry Potter, soit Lewis Carroll ou d'autres textes non identifiés. Quant aux noms des expéditeurs, ils sont visiblement inventés ou témoignent d'un humour douteux.
Mais, plus grave, on me propose aussi des médicaments, Cialis, Viagra, Valium... Si les deux premiers sont parfois bien utiles, le troisième risque d'être très dangereux. Ces médicaments ne sont délivrés que sur ordonnace. Bien entendu, les prix défient toute concurrence ! Il ne peut donc s'agir que de contrefaçons.
Il est hors de question pour moi d'acheter ces produits et, ce, pour plusieurs raisons :
Passons sur le danger des overdoses médicamenteuses, encore que Viagra et Cialis ne peuvent produire que du priapisme, douloureux certes mais passager (hélas !) Le valium peut tuer.
Mais ce qui m'interdit de céder à ces propositions est un réflexe de défense. Je ne me sens pas un citoyen hors pair, pourtant je répugne au vol à l'étalage. Ces propositions ne sont pas autre chose.
De plus, je suis auteur. A l'heure où un libéralisme forcené prétend supprimer le droit d'auteur au nom du "libre accès à la culture", où les bibliothécaires s'indignent que les écrivains réclament un droit sur le prêt de leurs oeuvres, prêt qui freine forcément la vente des livres, même si certains prétendent qu'après avoir lu un livre prêté on aura "forcément"envie de l'acheter, beaucoup oublient que ces droits sont souvent le seul revenu des auteurs. On demande aussi la libre diffusion et copie des oeuvres de l'esprit sur le Net ( textes ou musique) ou la libre disposition de logiciels pour lesquels ont travaillé des informaticiens.
Si on admet, pourtant, que ce libre accès à la culture est juste, alors ne nous arrêtons pas en chemin. Je demande le libre accès aux stades. Entrée gratuite pour le foot. Comment les joueurs gagneront-ils leur vie ? Ils feront autre chose, réponse déjà entendue. Libre accès à la Santé (même si vous croyez que ça existe déjà vous le payez quand même), gratuité des fruits et légumes, de la viande de boucherie, des fringues, des automobiles, des vacances, des voyages par avion...
Et comme trop d'Etat tue l'Etat, trop de libéralisme tuera le libéralisme.

Non ce sont en general de veritables pillules qui sont vendues, mais etant vendues offshore elles echappent a la taxation de l'etat. Ceci dit ce sont des individus peu recommandables et j'eviterai de traiter avec eux. Contrebande oui, contrefacon non.
Le melange Viagra + Vallium a une utilite, il empeche de rouler pendant la nuit et de tomber du lit.

Pas du tout. Un pillier du liberalisme est le respect de la propriete privee. Il y a plusieurs courants liberaux, l'ecrasante majorite reconnait la propriete intellectuelle - le droit d'auteur.
Certains courants plutot anarchistes rejettent la notion de propriete intellectuelle comme "naturelle" mais il reconnaissent que la propriete intellectuelle peut-etre garantie de maniere contractuelle, c.a.d
"Si vous ouvrez ce livre vous acceptez implicitement de ne pas plagier"
Dans tous les cas un systeme liberal respecte le droit d'auteur.
Examinons maintenant ce que ce "libre acces" a la culture dont on entend parler... Ca n'a rien d'une pensee liberale, bien au contraire c'est une pensee collectiviste!
Le liberalisme repose sur le concept de droit naturel et defini des libertes negatives, interdiction d'agresser son voisin, de violer un contrat etc. C'est l'esprit des lumieres, c'est l'esprit de la declaration des droits de l'homme et du citoyen de 1789...
Au contraire, le collectivisme et le socialisme reposent sur des declarations incantatoires de droits positifs, droit au logement, droit a l'emploi, droit au libre acces a la culture. C'est l'esprit de la declaration de 1793, celle de la Terreur, pas celle de la liberte et sur laquelle s'appuie encore notre constitution. Celle dont la gauche de la gauche demande l'application... Mais comme tu le fais remarquer il s'agit ici de declarations bien pensantes remettant en cause le droit fondamental de tout individu a la propriete... Droit d'aller voler a l'etalage donc? Le logement, l'emploi ou meme la culture sont naturels dans une societe libre et prospere.

C'est une question de contrat associe au support. Les producteurs de film l'on bien compris. Si le livre precise que son achat implique une redevance a l'auteur en cas de pret les bibliothecaires n'ont rien a dire.
Je pense en revanche qu'on ne peut pas remettre en cause la situation actuelle, le principe de non retroactivite du droit et des contrats est fondamental a la liberte. Cela ne peut donc concerner que les nouveaux livres.

Le mouvement du logiciel libre est un ensemble d'informaticiens qui decident volontairement de distribuer librement leur travail. Ils encouragent les autres a le faire mais n'y obligent personne.
Malheureusement ils forment une concurrence desagreable pour certaines entreprises monopolistiques sur le marche qui cherchent l'appuis des gouvernements pour les etouffer...
Un chanteur ne remet pas en cause le droit d'auteur s'il decide de chanter gratuitement dans la rue.
